Hunter Biden’s efforts to dismiss all of his tax charges were unsuccessful on Monday, allowing the criminal case against him to proceed.
According to The Hill, a federal judge in California has ruled against the younger Biden.
Biden has been charged with three felonies and six misdemeanors for alleged tax evasion, filing a false return, and failure to pay taxes from 2016 to 2019.
Biden has entered a plea of not guilty for all charges.
According to a report by Breitbart News, his attorneys claimed that the case was driven by political motives and was compromised by the involvement of two IRS agents who later came forward as whistleblowers.
The president’s son attempted to have the charges against him dismissed by filing eight separate motions. He cited various legal reasons for each motion, including claiming immunity from a previous plea deal he had negotiated. However, all of his motions were ultimately denied.
The U.S. District Judge Mark Scarsi ruled that the case was not influenced by political factors. He pointed out that Biden’s lawyers failed to present any evidence to support their claim, thus undermining Biden’s main argument.
He pointed out that the motion lacks any declaration, exhibit, or request for judicial notice. Instead, the Defendant references sections from various online sources, including news websites, social media posts, and legal blogs. These references, however, do not provide any proof.”
Scarsi mentioned that the sources, which primarily consist of media reports regarding the case, are filled with various levels of hearsay.
The Hill report highlights that the judge also dismissed Biden’s allegation of selective and vindictive prosecution.
“The defendant’s argument lacks any reasonable inference or clear evidence of discriminatory effect and discriminatory purpose,” Scarsi wrote.
“Therefore, the claim of selective prosecution is unsuccessful.”
Hunter Biden may potentially face a maximum of 17 years in prison if found guilty. The president’s son is potentially facing a significant amount of time in federal prison due to multiple tax and gun charges.
He faced charges for gun violations in Delaware and maintained his innocence, all while playing a crucial role as a witness in the House impeachment inquiry involving President Joe Biden.
